New regulations for CE products exported to the EU from July 16th, 2021
According to the requirements of the new EU product safety regulations "Market Supervision Regulations (EU) 2019/1020", starting from July 16, 2021 (local time), for most products with the CE mark in the EU (except the UK), the person in charge of the European Union is required as the contact person for their product compliance.
It means that if you export products to the EU with the CE mark, you must ensure before July 16th , 2021:
After July 16th ,
Products with the CE mark have a responsible person in the European Union ("EU Representative");
Products with the CE mark are affixed with the contact information of the responsible person in the European Union, including the name of the responsible person in the EU, registered trademark name, mailing address, email address, and telephone number, which should be reflected in the product, product packaging, package or accompanying documents;
To distinguish between manufacturer information and EU representative information, you can add "manufacturer" and "EU representative" before the corresponding contact information.
If after July 16, 2021, the product with the CE mark, but cannot provide the EU authorized representative information, the business will be judged to constitute an illegal act.
The consequences will include:
Most of the products with the CE mark that enter the EU from July 16, 2021, if the product packaging does not have the relevant information of the EU responsible person affixed, it may be detained or returned by the customs;
Goods that have entered the EU customs will be detained and destroyed because they do not have the information of the EU responsible person;
Commodities that are already circulating in the market are at risk of being complained.
Since usually there are EU importers in traditional foreign trade, it is relatively easy to find qualified economic operators in the EU as authorized representatives. Therefore, the implementation of the new regulations will have a greater impact on cross-border e-commerce export companies. For those cross-border e-commerce Guys, besides paying attention to the EU VAT reform in July, we also need to pay attention to this change!
If the export company does not have a manufacturer or importer established in the EU for its products, it is recommended that the export company find a suitable authorized representative (EU representative) in the market.
The European Union has issued 25 technical directives (each directive is for a specific product category). Except for medical devices, civil explosives, and certain elevators and ropeway devices, all products with the CE mark in the European Union are subject to this regulation.
Such as toys, electronic products, personal protective equipment, machinery, construction goods, gas equipment, leisure and private boats, pressure vessels, and measuring equipment.
